TERMS AND CONDITIONS OF THE ‘GARESETCONNEXIONS.SNCF’ SITE

1. INTRODUCTION

Use of the ‘garesetconnexions.sncf’ site implies full acceptance of the terms and conditions as set out below (the ‘T&Cs’). The present T&Cs are intended to define the terms and conditions for using the site. These terms and conditions may be modified or supplemented at any time. Users will be asked to accept the new applicable terms and conditions the next time they use the services or, following advance information about the modification of said T&Cs informing them of the upcoming introduction of such modifications and enabling them, if they so wish, to terminate their use of the services.

The Site is usually accessible 24 hours a day and 7 days a week. An interruption due to technical maintenance can however be decided by SA SNCF Gares & Connexions who will endeavour to communicate the dates and time of such action to Users in advance. Accessibility may also be interrupted in the event of force majeure or technical difficulties. SA SNCF Gares & Connexions may not be held responsible for malfunctions of the network or servers or any other event beyond its control, which could interfere with or hinder access to the services.

The Site is regularly updated by SA SNCF Gares & Connexions.

 

2. DEFINITIONS

Site: refers to the ‘garesetconnexions.sncf’ website available at the following address: garesetconnexions.sncf

SA SNCF Gares & Connexions: Public limited company with registered office at 916 Avenue d'Ivry 75013 Paris, registered with the Bobigny Trade and Companies Register under number B.552.049.447 and SIRET number 552 049 447 91146, with capital of 4,970,897,305.00 euros

User: refers to any physical person, of legal age and capacity, using the Site, under their own responsibility and who has previously accepted the present terms and conditions.

Lost & Found service: refers to the service provided by SA SNCF Gares & Connexions for Users to report on the Site if they have lost an item at a station or on board a train.

Personal Data: information collected by SA SNCF Gares & Connexions in the context of operation of the Site which may directly or indirectly identify a User.

Partner: refers to any physical or moral person whose services are listed on the ‘garesetconnexions.sncf.fr’ site.

 

3. PRESENTATION OF THE "GARESETCONNEXIONS.SNCF" SITE
 

  • 3.1 GENERAL PRESENTATION OF THE SITE

The purpose of the Site is to provide Users with real time information about departures, arrivals and disruptions at the main stations of France, as well as additional services available before, during or after the journey, at the station or nearby. Services accessible at stations are provided in the form of a directory for all stations and in the form of an interactive map for some stations.

The service provided by SA SNCF Gares & Connexions is purely for utility and information purposes.

The information featured on the Site is not exhaustive. It is provided subject to modifications introduced since it has been put online.

For external services related to the Site, Users are redirected to the relevant Website in a new window. The entire transaction will therefore be subject to the terms and conditions of the said site, and SA SNCF Gares & Connexions will not bear any liability for a fault by this Website.

 

  • 3.2 PRESENTATION OF THE LOST & FOUND SERVICE

The purpose of the Lost & Found service is to enable visitors to:

  • report a lost item online, whether it has been lost at a station or on board a train
  • know the progress of the search for lost items
  • pay the return fee
  • obtain information about the Lost & Found service of their choice
  • know the steps to report a found item

The User can report a lost item by entering their contact details and characteristics of the item. This data feeds into the national database of services provided by SA SNCF Gares & Connexions. The service can be accessed 24 hours a day and 7 days a week.

 

4. CONTRACTUAL LIMITATIONS REGARDING TECHNICAL DATA


The minimum configuration required to access the Site is as follows:

  • Browsers: IE 8, 9, 10, Safari, Mozilla Firefox, Google Chrome
  • Screens: 320px, 480px, 600px, 801px, 1025px, 1281px
  • The User of the Site agrees to access the Site using equipment that meets the configuration requirements described above, and without any viruses.

 

5. INTELLECTUAL PROPERTY
 

All elements of the Site, its general structure, hierarchical organisation, and also the software, texts, animated or non-animated images, sounds, expertise, graphics and all other components of the Site are the exclusive property of SA SNCF Gares & Connexions who holds the usage rights, and are protected under intellectual property law.

Gares & Connexions is a duly registered trademark of SNCF. The SNCF Gares & Connexions logo is also protected as a semi-figurative trademark.

Any reproduction, presentation, modification, publication, adaptation of all or part of the website's elements, regardless of the means or process used, is prohibited, unless prior written authorisation is provided by SA SNCF Gares & Connexions.

Any unauthorised use of the website or of any of the elements it contains shall be considered as an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.

The brands and logos of Partners featuring on the Site are trademarks registered by their respective owners. In accordance with French law, any total or partial reproduction or presentation of these brands or logos, alone or integrated with other elements, without prior and express written authorisation from the owner of the brand or logo is prohibited, and would incur the liability of the User as defined by articles L. 713-2 and L. 713-3 of the Intellectual Property Code.

The same applies to extraction and reuse of content of databases featured on the Site which are protected by provisions of the law of 1 July 1998 regarding transposition in the intellectual property code of the European Directive of 11 March 1996 relating to legal protection of databases. As such, any reproduction, reuse or extraction of the database content shall incur the liability of the User.

 

6. LIMITATION OF LIABILITY
 

SA SNCF Gares & Connexions endeavours to provide as accurate information as possible on the Site. However, SA SNCF Gares & Connexions is only bound by an obligation of means regarding the accuracy of information provided and shall not bear any liability for omissions, inaccuracies, imprecisions and lack of updates, whether they are due to their own actions or to third party partners who provide them with this information.

Furthermore, SA SNCF Gares & Connexions shall not bear any liability in case of incompatibility between the information provided, the services offered and the needs of the User.

SA SNCF Gares & Connexions reserves the right to modify the Site content at any time and without warning, interrupt or suspend all or part of the features of the Site at any time and without warning; and the User shall have no recourse against SA SNCF Gares & Connexions. SA SNCF Gares & Connexions shall not bear any liability for consequences of these modifications and interruptions.

As SA SNCF Gares & Connexions does not participate in the offers and products listed on the Site, it cannot in any regard be considered a commercial agent.

As an intermediary between its Partners and the User, SA SNCF Gares & Connexions cannot guarantee the accuracy of the information published. The Site content is published exclusively for informational purposes and therefore does not incur the liability of SA SNCF Gares & Connexions when it comes to the promotional offers and products featured on it.

Any questions, claims or requests from the User must consequently be addressed directly to the businesses of the offers and products concerned.

The User is liable to SA SNCF Gares & Connexions and/or third parties for any material and/or immaterial, direct and/or indirect damage, of any kind caused by the User and/or their representatives due to use of the Site contrary to these terms. The User guarantees SA SNCF Gares & Connexions and its parent, sister or affiliate companies and its representatives, employees and partners against any demand, claim and/or recourse of any kind which results from any violation of these provisions.

SA SNCF Gares & Connexions shall not bear any liability in case of use contrary to the T&Cs.

Furthermore, SA SNCF Gares & Connexions reserves the right to temporarily or permanently refuse access, without any warning, to services to any User who does not abide by the present Terms and Conditions.

Use of the Site is at the sole risk of the User.

The User acknowledges that they are fully aware that the data cannot be fully protected against all forms of intrusion (hacking). The User acknowledges that it is impossible to guarantee total security of data transmitted.

Consequently, SA SNCF Gares & Connexions shall in no circumstances be liable for any direct or indirect damage including but not limited to infection by viruses, loss of data or programmes, loss of use of IT equipment (including software, hard disks or any system), financial losses (such as loss of a deal or loss of an opportunity) following a visit or use of the Site.

 

7. INFORMATION RELATIVE TO PERSONAL DATA


As part of the operation of the Site, SA SNCF Gares & Connexions may collect some personal data. This will be processed in accordance with law 78-17 dated 6 January 1978 and European regulation 2016/679 dated 27 April 2016.

The Personal Data is for SA SNCF Gares & Connexions which is also the data controller.

Personal Data collected by the Site helps in the running of services offered by the Site. It also facilitates contact with the User, subject to their consent, by means of electronic communications to inform them about services at stations. When creating their Customer Account, the User, subject to their consent, will receive electronic communications with commercial offers from partners of SA SNCF Gares & Connexions.

8. HYPERTEXT LINKS AND COOKIES


Insertion of hypertext links to any part of the Site is prohibited without written prior authorisation from SNCF Gares & Connexions.

The Site contains a number of hypertext links to other sites or applications, used with the authorisation of SA SNCF Gares & Connexions.

SA SNCF Gares & Connexions is unable to verify the content of sites and applications visited in this way, and consequently will not accept any liability.

9. INVALIDITY OF A CLAUSE

The invalidity in whole or in part of one or more of the provisions of these Terms and Conditions, under the terms of a legal or regulatory provision or a legal decision that has become definitive does not mean the invalidity of the other provisions or the part of the provision that is not invalid.

 

10. MEDIATION

In the event of a dispute related to the use of our services, the User can send a written claim to the following address: SNCF Gares & Connexions - Direction de la Communication 16 Avenue d'Ivry - 75634 PARIS CEDEX 13.

In accordance with Articles L. 612-1 and seq. of the Consumer Code, and in the event of an unsatisfactory response or lack of response from us, the User has the option to appeal to the SNCF mediator in the following way:

The mediation phase may not exceed 90 days from acknowledgement of receipt of the Mediator’s referral. Throughout the mediation process, the parties must not initiate any legal proceedings against each other in the context of the present T&Cs. At the end of the time allocated for mediation and if no agreement has been concluded, each of the parties will again have the option to take legal action.

Use of the mediator is free, confidential and optional.

The User may also, if they so wish, take direct action for the resolution of any dispute resulting from their contract or related to this, in accordance with the eJust Arbitration Regulation.

 

11. APPLICABLE LAW AND ASSIGNMENT OF JURISDICTION 

Any potential dispute including relating to the application, execution, interpretation and/or validity of the Terms and Conditions and/or use of the Site and/or services offered, where an amicable solution cannot be found, will be subject to French law. Exclusive jurisdiction is granted to the competent courts of Paris.
